The International Court of Justice (ICJ) has stated that ‘Israel’ failed to provide proof for its allegations that UNRWA staff are members of Hamas. The court has ordered ‘Israel’ to facilitate the entry of vital aid into the Gaza Strip and ensure Palestinians receive basic survival needs.
The broad ruling supports ongoing efforts by humanitarian groups to scale up aid delivery during a fragile ceasefire. ICJ President Yuji Iwasawa specified that ‘Israel’ is obligated to cooperate with relief schemes provided by the UN and its affiliated bodies, including UNRWA.

‘Israel’ had banned the UN agency for Palestinian refugees, claiming some staff participated in the October 7th operation. The court, however, dismissed these claims, with President Iwasawa stating, “the court finds that ‘Israel’ has not substantiated its allegations.”
Following the decision, Norway announced it will propose a new UN General Assembly resolution demanding ‘Israel’ lift its restrictions on aid to Gaza. Norwegian Foreign Minister Espen Barth Eide confirmed the plan, stating his country intends to “follow up on this decision.”
While ‘Israel’ did not participate in the court proceedings, an official had previously argued the case was an abuse of international law and clarified that the occupation would not cooperate with UNRWA, despite working with other UN agencies.
Hamas Welcomes ICJ Advisory Opinion
The Hamas Movement has welcomed the advisory opinion issued today by the International Court of Justice (ICJ), which refuted the false claims made by the Israeli occupation entity against the United Nations Relief and Works Agency for Palestine Refugees (UNRWA).
In a press statement, Hamas affirmed that the ruling underscores the critical humanitarian role played by UNRWA and other UN institutions in providing relief to the Palestinian people in Gaza.
Hamas stated that the ICJ’s decision to ban the use of starvation as a weapon of war confirms that the occupation, through its deliberate starvation of Palestinians, is committing a form of genocide.
On October 7, 2023, the Israeli occupation committed acts of genocide in the Gaza Strip, including killing, starvation, destruction, and forced displacement, all in clear disregard for international appeals and ICJ orders to halt such crimes.
The genocide has resulted in more than 238,000 killed and wounded, most of them children and women. Additionally, over 9,000 people remain missing, and hundreds of thousands of displaced individuals face famine, with many already having died from hunger. Massive destruction has also ravaged homes and vital infrastructure across Gaza.
